  संविधान की प्रस्तावना                           ४२वें संशोधन से पूर्व भारत के संविधान की प्रस्तावना                                                      भारतीय संविधान की उद्देशिका संविधान के उद्देश्यों को प्रकट करने हेतु प्राय: उनसे पहले एक प्रस्तावना प्रस्तुत की जाती है। भारतीय संविधान की प्रस्तावना अमेरिकी संविधान से प्रभावित तथा विश्व में सर्वश्रेष्ठ मानी जाती है। प्रस्तावना के नाम से भारतीय संविधान का सार, अपेक्षाएँ, उद्देश्य उसका लक्ष्य तथा दर्शन प्रकट होता है। प्रस्तावना यह घोषणा करती है कि संविधान अपनी शक्ति सीधे जनता से प्राप्त करता है इसी कारण यह 'हम भारत के लोग' - इस वाक्य से प्रारम्भ होती है। केहर सिंह बनाम भारत संघ के वाद में कहा गया था कि संविधान सभा भारतीय जनता का सीधा प्रतिनिधित्व नहीं करती अत: संविधान विधि की विशेष अनुकृपा प्राप्त नहीं कर सकता, परंतु न्यायालय ने इसे खारिज करते हुए संविधान को सर्वोपरि माना है जिस पर कोई प्रश्न नहीं उठाया जा सकता है। संविधान की प्रस्तावना : हम भारत के लोग, भारत को एक सम्पूर्ण प्रभुत्व सम्पन्न, समाजवादी , पंथनिरपेक्ष,लोकतंत्रात्
